Welcome to My Butchers Block.
These Terms of Service govern your access to and use of our website, www.mybutchersblock.co.za, and your purchase of products from us.
Throughout these Terms, the words “we”, “us” and “our” refer to My Butchers Block. The words “you” and “your” refer to the person accessing our website or purchasing products from us.
By accessing our website, placing an order or using any of our services, you agree to be bound by these Terms, together with our Privacy Policy, Refund Policy and Shipping Policy.
Nothing in these Terms is intended to exclude or limit any rights that you may have under the Consumer Protection Act, 68 of 2008, the Electronic Communications and Transactions Act, 25 of 2002, or any other applicable South African law.
1. General Conditions
Acceptance of these Terms
By accessing or using our website, you confirm that you have read, understood and agreed to these Terms.
If you do not agree to these Terms, you should not use our website or place an order.
Eligibility
You must be at least 18 years old, or have the assistance and consent of a parent or legal guardian, to place an order through our website.
By placing an order, you confirm that you have the legal capacity to enter into a binding agreement.
Changes to the Services
We reserve the right to update, modify, suspend or discontinue any part of our website, products or services, subject to applicable law.
We may also update these Terms from time to time. The latest version will be published on our website with an updated effective date.
2. Products and Product Information
Product descriptions
We take reasonable care to ensure that product descriptions, dimensions, specifications, images and other information displayed on our website are accurate.
However, colours, wood grain, texture and appearance may vary depending on:
- The natural characteristics of the wood;
- Lighting conditions;
- Photography;
- Screen and device settings; and
- The handmade nature of certain products.
Minor natural variations are not defects.
Handmade and natural products
Many of our wooden products are handmade or produced from natural materials.
Natural variations may include:
- Differences in wood grain;
- Colour variations;
- Knots;
- Small mineral marks;
- Slight dimensional differences; and
- Variations in finish.
These characteristics form part of the natural appearance of the product and may make each item unique.
Product dimensions
Dimensions displayed on the website are approximate unless expressly stated otherwise.
Reasonable manufacturing tolerances may apply to handmade or natural products.
Product images
Product images are provided for illustrative purposes.
Accessories, food, decorations or other items shown in photographs are not included unless specifically stated in the product description.
Website errors
We reserve the right to correct errors, inaccuracies or omissions relating to:
- Product descriptions;
- Pricing;
- Promotions;
- Delivery charges;
- Availability; and
- Other website content.
Where an error affects an order already placed, we will contact you and provide an appropriate option, which may include confirming the corrected information or cancelling and refunding the affected order.
3. Pricing and Payment
Prices
All prices are displayed in South African Rand and include VAT unless stated otherwise.
Delivery charges, engraving charges or other additional costs will be shown before checkout where applicable.
Pricing changes
Prices may change without prior notice.
A price change will not affect an order that we have already accepted, except where there has been an obvious pricing or system error.
Payment
Payment must be completed using one of the payment methods available at checkout.
Orders will generally not be processed until payment has been authorised or received.
Payment processing
Payments may be processed by Shopify or another authorised third-party payment provider.
We do not necessarily receive or store your full payment-card details.
Your use of a third-party payment service may also be subject to that provider’s terms and privacy policy.
Failed or reversed payments
We may suspend or cancel an order if:
- Payment is declined;
- Payment cannot be verified;
- Payment is reversed;
- Fraud is suspected; or
- The payment provider advises us not to proceed.
4. Orders
Placing an order
Submitting an order through our website constitutes an offer to purchase the selected products.
An automated order confirmation acknowledges that we have received your order. It does not necessarily mean that we have accepted it.
Order acceptance
An order is accepted when:
- We confirm that the order has been accepted;
- We begin processing or producing the order; or
- The order is dispatched,
whichever happens first.
Refusing or cancelling an order
We may refuse, limit or cancel an order where reasonably necessary, including where:
- A product is unavailable;
- There is a pricing or description error;
- Payment cannot be verified;
- Fraud or misuse is suspected;
- The order appears to be placed for unauthorised resale;
- A delivery address cannot reasonably be serviced; or
- We are legally prohibited from completing the transaction.
If we cancel an order after receiving payment, we will refund the amount paid for the cancelled portion.
Quantity limits
We may limit quantities purchased per customer, household, account or order.
For wholesale or bulk orders, separate terms, pricing and minimum-order quantities may apply.
5. Personalised and Engraved Products
Customer-supplied information
You are responsible for checking all names, wording, spelling, dates, logos, artwork and other personalisation details before submitting your order.
We are not responsible for errors contained in information approved or supplied by you.
Production
Once production or engraving has begun, changes or cancellations may not be possible.
Any requested change after production begins may be subject to additional charges.
Returns
Personalised, custom-made and engraved products generally cannot be returned because of a change of mind.
This does not affect your rights where the product is defective, unsafe, incorrectly supplied or does not match the agreed specification.
Artwork and permissions
By supplying logos, photographs, artwork, text or other content, you confirm that:
- You own the content or have permission to use it;
- Our use of it to complete your order will not infringe another person’s rights; and
- The content is not unlawful, offensive or misleading.
We may refuse personalisation requests that we reasonably believe are unlawful, offensive or infringe third-party rights.
6. Delivery
Delivery addresses
You must provide a complete and accurate delivery address.
We are not responsible for delays or additional charges caused by incorrect or incomplete information supplied by you.
Delivery estimates
Any delivery timeframe displayed on our website or communicated to you is an estimate unless expressly confirmed as a guaranteed delivery date.
Delivery may be affected by circumstances outside our reasonable control, including:
- Courier delays;
- Severe weather;
- Road closures;
- Strikes;
- Load shedding;
- Supplier delays;
- Public holidays;
- Remote delivery locations; and
- Other operational disruptions.
Delivery attempts
You are responsible for ensuring that someone is available to receive the delivery.
Additional courier charges may apply where delivery fails because:
- Nobody is available;
- The address is incorrect;
- Access is refused; or
- The parcel is not collected from an agreed collection point.
Inspection on delivery
You should inspect your order as soon as reasonably possible after delivery.
Please notify us promptly if:
- An item is damaged;
- An item is missing;
- The wrong product was supplied; or
- The order appears to have been tampered with.
Photographs of the product and packaging may be required to investigate a claim.
Risk
Risk in the products passes to you when the products are delivered to the address supplied by you or collected by you or your authorised representative.
Nothing in this section limits any rights you may have under applicable consumer law.
7. Returns, Exchanges and Refunds
Returns, exchanges and refunds are governed by our Refund Policy, which forms part of these Terms.
Nothing in our Refund Policy or these Terms limits rights granted to consumers under applicable South African law.
Where applicable, consumer rights may include rights relating to defective, unsafe, poor-quality or incorrectly supplied goods.
Any cooling-off or cancellation rights that apply to an electronic transaction will be dealt with in accordance with applicable law.
8. Product Care and Use
You are responsible for:
- Following the care instructions supplied with the product;
- Using the product only for its intended purpose;
- Avoiding misuse or neglect;
- Keeping wooden products away from dishwashers and prolonged soaking, unless stated otherwise;
- Drying wooden products properly after cleaning; and
- Applying appropriate wood-care products where recommended.
Damage caused by improper use, poor maintenance, neglect, unauthorised alteration or failure to follow care instructions may not qualify as a product defect.
9. Promotions and Discount Codes
Promotions and discount codes may be subject to separate conditions.
Unless otherwise stated:
- Promotions cannot be exchanged for cash;
- Discount codes cannot be combined;
- Discount codes must be used before expiry;
- Discounts cannot be applied retrospectively;
- Promotions are subject to stock availability; and
- Delivery charges may be excluded.
We may withdraw or correct a promotion where there is an obvious error, fraud or misuse, subject to applicable law.
10. Competitions
Competitions may be governed by additional competition rules.
By entering a competition, you agree to the applicable rules made available for that competition.
Where photographs or content are submitted, the competition rules may include permission for us to repost or use that content for promotional purposes.
11. Customer Accounts
You are responsible for:
- Maintaining the confidentiality of your login details;
- Ensuring that your account information is accurate;
- Restricting access to your device and account; and
- Notifying us promptly of suspected unauthorised access.
You are responsible for activity conducted through your account unless caused by our fault or a security failure for which we are legally responsible.
We may suspend or terminate an account where there is suspected fraud, unlawful activity, abuse or a material breach of these Terms.
12. AI-Assisted Chat
Our website may use Shopify Inbox and AI-assisted chat.
AI-generated responses are provided for general assistance and may not always be complete, accurate or current.
You should obtain confirmation from a member of our team regarding important matters, including:
- Pricing;
- Product availability;
- Delivery commitments;
- Returns;
- Refunds;
- Custom orders; and
- Legal rights.
An AI-generated response does not amend these Terms or create a binding commitment unless confirmed by an authorised member of our team.
13. Intellectual Property
Ownership
All content available through our website, including:
- Text;
- Photographs;
- Product designs;
- Graphics;
- Videos;
- Logos;
- Trade names;
- Layouts;
- Downloads; and
- Software,
belongs to My Butchers Block, its licensors or its content suppliers and is protected by applicable intellectual-property laws.
Permitted use
You may access and use the website for personal, lawful and non-commercial shopping purposes.
Prohibited use
You may not, without prior written permission:
- Copy or reproduce website content;
- Republish product photographs;
- Use our branding or logos;
- Modify or create derivative works;
- Scrape or extract website data;
- Sell or commercially exploit website content;
- Reverse-engineer website software; or
- Use our content to train an artificial-intelligence system or commercial dataset.
14. Customer Reviews and Submitted Content
Where you submit a review, photograph, comment or other content, you grant us a non-exclusive, worldwide, royalty-free licence to use, reproduce and display that content in connection with our business and marketing.
You confirm that submitted content:
- Is accurate;
- Is lawful;
- Does not infringe intellectual-property or privacy rights;
- Is not defamatory or abusive;
- Does not contain malicious code; and
- Does not mislead other customers.
We may remove submitted content that breaches these Terms.
15. Prohibited Conduct
You may not use our website:
- For unlawful purposes;
- To violate another person’s rights;
- To infringe intellectual-property rights;
- To submit false or misleading information;
- To transmit viruses or harmful code;
- To interfere with website security;
- To gain unauthorised access to systems or accounts;

- To commit or facilitate fraud; or
- To interfere with another customer’s use of the Services.

No wording in these Terms excludes or limits liability that cannot legally be excluded or limited.

To the fullest extent permitted by law, we will not be liable for indirect, incidental, special or consequential losses that were not reasonably foreseeable at the time of the transaction.
This may include loss of profit, revenue, business opportunity or data.
However, nothing in these Terms excludes or limits liability:
- For death or personal injury caused by negligence where liability cannot legally be excluded;
- For fraud or fraudulent misrepresentation;
- For gross negligence where applicable;
- For defective or unsafe goods where liability cannot legally be excluded;
- For a breach of statutory consumer rights; or
- Where exclusion or limitation is prohibited by law.
Our liability will always remain subject to the Consumer Protection Act and other applicable legislation.
20. Indemnity
To the extent permitted by law, you agree to indemnify us against claims, losses or expenses arising from:
- Your unlawful use of the website;
- Your material breach of these Terms;
- Content supplied by you that infringes another person’s rights; or
- Fraudulent or malicious conduct by you.
This indemnity does not apply to the extent that a claim results from our negligence, breach of law or wrongful conduct.
21. Events Outside Our Control
We will not be responsible for a failure or delay caused by circumstances outside our reasonable control.
These may include:
- Natural disasters;
- Fire;
- Flooding;
- War;
- Civil unrest;
- Government restrictions;
- Strikes;
- Courier disruptions;
- Power or telecommunications failures;
- Cyberattacks;
- Supplier failures; and
- Other force majeure events.
We will take reasonable steps to reduce the effect of the disruption.
22. Governing Law and Disputes
These Terms are governed by the laws of the Republic of South Africa.
The parties should first attempt to resolve any dispute in good faith by contacting each other directly.
Nothing in these Terms prevents a consumer from exercising any right to approach:
- The National Consumer Commission;
- A relevant consumer-protection body;
- The Information Regulator;
- An ombud with jurisdiction; or
- A competent court.
Any court proceedings will be subject to the jurisdiction of the South African courts, subject to any consumer right to approach another competent forum.
23. Severability
If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be limited or removed only to the extent necessary.
The remaining provisions will continue to apply.
24. No Waiver
If we do not immediately enforce a provision of these Terms, this does not mean that we have waived our right to enforce it later.
25. Entire Agreement
These Terms, together with our Privacy Policy, Refund Policy, Shipping Policy and any additional terms displayed for a product or promotion, form the agreement between you and us regarding your use of the Services.
26. Changes to These Terms
We may update these Terms to reflect changes to:
- Our products or Services;
- Shopify’s functionality;
- Our business operations;
- Applicable laws; or
- Security and operational requirements.
The updated Terms will be published on our website with a revised effective date.
Changes will not unfairly remove rights that already apply to a completed transaction.
